Terms of Service

These Terms of Service (“Terms”) govern the website, products (especially AstraDeck, Lunatum Synthesizer, etc.) and related services offered by Aytunç Burak Yüksel under the Sky Synthesis brand (“we”, “seller”). By using our website or products, you are deemed to have accepted these Terms.

1. Definitions

• Service: skysynthesis.com, our digital platforms, and the design, production, and delivery of hardware products (AstraDeck, etc.).
• Products: Customer-customised AstraDeck cards, Lunatum Synthesizer, and all physical hardware provided by the seller.
• Customer: Any natural or legal person who uses the Service or purchases a product.

2. Service Description

AstraDeck is a product family that permanently binds a Spotify content link selected by the customer and the customer’s customised design to a physical NFC card. The Service does not include direct integration with the customer’s Spotify account; it only processes the URI provided by the customer and turns it into a physical object. Production is carried out by hand in small batches. Production and shipping times are notified separately at the time of order.

3. Orders and Payment

Orders are not taken directly through our website; they are received through authorised third-party sales channels (e.g. Etsy). Payment transactions are carried out by the relevant channel’s infrastructure; we do not store or process your card details. After an order is received, a configurator link is sent by email so you can set your customisation preferences (including image upload). Production starts after you give submission approval.

4. Right of Withdrawal and Returns

Under Türkiye’s Consumer Protection Law No. 6502, consumers have a right of withdrawal within 14 days for distance contracts. However, goods prepared specially for the person or made specific upon the customer’s request are excluded from the right of withdrawal under Article 15/1-b of the Distance Contracts Regulation. Because our products are produced for each customer according to uploaded photos, Spotify content, and custom designs, they fall into the customised product category and are excluded from the right of withdrawal. Where a product is defective or damaged, exchange/return will be arranged within our legal obligations.

5. User Content, Hardware Use, and General Disclaimer

Sky Synthesis provides an automated production and hardware infrastructure for AstraDeck, Lunatum Synthesizer, and other physical/digital products offered. None of the content uploaded by users to our platforms (images, logos, text, audio files, Spotify URIs, etc.) is manually filtered or reviewed by us for intellectual property, copyright, trademark rights, personality rights, or legality.

By uploading any content to the system, you accept, declare, and undertake that you fully and completely own all copyright, industrial property, trademark, use, reproduction, and licence rights to that content (including legal permissions from third parties and KVKK/GDPR data processing consents). All legal, administrative, and criminal responsibility arising from uploaded content being defamatory, infringing copyright/trademark rights (DMCA, etc.), or unlawful belongs absolutely to the customer. Sky Synthesis cannot be held responsible for such content; you agree to compensate all direct or indirect damages that may arise.

Hardware, circuit designs, and embedded software (firmware) produced by the seller are subject to intellectual and industrial property rights; reverse engineering of Products, unauthorised copying of hardware or software, or modifying and reproducing them for commercial purposes is strictly prohibited. Sky Synthesis reserves the right, entirely at its own discretion, to reject or cancel orders that are unlawful, defamatory, or constitute intellectual property infringement, and to terminate the transaction by refunding the payment.

6. Intellectual Property

The Sky Synthesis brand, AstraDeck and Lunatum brands, product design systems, circuit designs, software, and graphic elements belong to Sky Synthesis. The customer purchases the product only for personal use; commercial reproduction is subject to permission. Images and texts uploaded by the customer remain the customer’s own content; the seller has only a limited right to use them for production, printing, and delivery.

7. Limitation of Liability

Sky Synthesis is not responsible for:

• Incompatibility of products with external hardware or user account settings.
• Damages arising from causes outside ordinary use (misuse, modification, liquid contact, accidental damage).
• Criminal or legal consequences arising from unlawfulness of customer-provided content.

Our total liability is limited to the payment amount of the relevant order (except for cases where liability cannot be excluded by law, such as bodily injury).

8. Third-Party Services, APIs, and Integrations

Sky Synthesis products (AstraDeck, Lunatum, etc.) and digital platforms may work integrated with application programming interfaces (APIs), such as the Spotify API, and external infrastructure provided by third-party service providers in order to perform their functions. These services are controlled by the relevant companies (e.g. Spotify AB) and are subject to their own Terms of Service.

Sky Synthesis does not guarantee that third-party APIs and services will operate without interruption, remain permanent, or remain free. Sky Synthesis accepts no responsibility if our devices partially or completely lose functionality because a third-party API is closed to access, its terms of use change, or the relevant platform removes content/accounts. Such externally caused technical disruptions are not within the scope of hardware warranty or fee refund.

9. Warranty

Our products are warranted against manufacturing defects for 2 years from the delivery date (Consumer Protection Law Art. 56). We provide free replacement for manufacturing defects that appear under ordinary use (NFC read failure, hardware failure). Customer-caused damage is outside the warranty scope.

10. Changes to the Service

We may update our services, product line, or these Terms from time to time. Material changes will be notified to your registered email address, and the current version of the Terms is always published on this page.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye. For disputes within monetary limits, Istanbul Anadolu Provincial/District Consumer Arbitration Boards and Consumer Courts are authorised; for disputes that do not qualify as consumer disputes, Istanbul Anadolu Courts and Execution Offices are authorised.

12. Language, Translation, and Validity of Material Errors

Even if these Terms and the Privacy Policy are translated into different languages, in case of ambiguity, translation errors, or interpretation differences, the Turkish original text will always be legally valid and binding.

In addition, in cases arising from typographical errors, system failures, incorrect pricing, or inevitable technical colour/tone differences between digital screens and physical printing (printing discrepancies) on the website or configurator, the seller reserves the right to correct texts and orders, cancel the order, or terminate the transaction by refunding the order amount.
